Eugene Springfield Cat Lounge (registered business name Eugene Cat Cafe, LLC)

 

I, the undersigned entrant, acknowledge and agree as follows:

 

• Eugene Springfield Cat Lounge has cats on the premises and has agreed to allow me to visit and interact with these cats in consideration of both the payment of a fee and my execution of this Waiver and Release of Liability (“Release”) and agreement to be bound by its terms.

• I understand that cats can be unpredictable in nature and may react to people, sounds, and sudden movements that could result in injuries to people, including but not limited to, scratches or bites. I am knowingly, voluntarily and willingly assuming all liability and assumption of the risk related to interaction with cats. This includes, but is not limited to, injuries of any kind, bites, scratches, infections (including ringworm), illness, allergies, and physical, emotional and financial injuries and damages, some or all of which may be severe (collectively, “Injuries).

• I have no physical or emotional issue(s), including, but not limited to, any allergies, which would adversely affect my ability to play with the cats in a safe and appropriate manner.

• I will treat the cats kindly, gently, and with respect and appropriately watch for signs of irritation or aggression.

• If Injuries occur which require medical or other treatment, sustained directly or indirectly as a result of entering the cat room or any activity involving or related to the cats at Eugene Cat Cafe, LLC, I agree to be fully liable, legally, financially or otherwise for any and all costs, expenses or other burdens incurred as a result of such care.

• I agree to abide by and follow all rules and regulations that Eugene Cat Café, LLC may impose regarding the cats. I understand that if I am unable to follow all rules and regulations, Eugene Cat Cafe, LLC may terminate my interaction with the cats and I will not be entitled to any refund of fees that have been paid. I further understand that the staff of Eugene Cat Café, LLC reserve the right to ask anyone at any time to leave, with no refund, for any reason.

• I, for myself, my heirs, executors, administrators, assigns, or personal representatives, hereby release, waive, discharge and relinquish any action or causes of action which may hereafter arise for myself or my estate, and agree that under no circumstances will I or my heirs, executors, administrators, assigns or personal representatives prosecute, present any claim for injury, death or damages against Eugene Cat Cafe, LLC or its members, managers, partner shelters and rescues, agents, employees, landlords, lessees, affiliates, successors or assigns (collectively, “Released Parties”) for any of said causes of action, whether the same shall arise by the intentional or negligent act or omission of any said person or otherwise. It is my intent to exempt and relieve the Released Parties from liability for injury, death or damages caused by negligence. 

• I agree to indemnify and hold harmless the Released Parties against any and all claims, suits actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney fees and any related costs, if litigation arises pursuant to any claims made by me or anyone acting on my behalf.

• I am eighteen (18) years of age or older. 

 

I CERTIFY THAT I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, I FULLY UNDERSTAND ITS CONTENT, AND I ACKNOWLEDGE AND VOLUNTARILY ACCEPT ALL THE TERMS ABOVE.

PARENT OR GUARDIAN WAIVER FOR MINORS (under the age of 18):
I hereby certify that I have legal capacity and authority to act on behalf of the minor(s) named below. I agree to indemnify and hold harmless the Released Parties from any claim brought by or on behalf of the minor(s) named below and I assume and accept the assumption of risks as described herein for the minor(s) listed below.
